Latest vstest builds do not build in sourcebuild with nullability enabled

As discussed in dotnet/installer#16005 (comment) there is a missing null check that causes the sourcebuild build to fail.

fix is #4391 this is time sensitive for the dotnet org so quick triage would be appreciated
